What is the issue over copper ionisation in legionella control?
From 1 February 2013, the Biocidal Products Directive and the national Biocidal Products Regulations 2001, which implement the Directive in Great Britain, no longer allowed the marketing and use of elemental copper as a biocide. The decision, taken by the European Commission (EC), was because no manufacturer took sufficient action to support the biocidal use of elemental copper during a review period that ended in September 201
HSE submitted an application for �essential use derogation� to the EC to allow for the continued use of copper in Legionella control systems within the UK. Following the commenting period that ended 20 April 2013, the European Biocides Competent Authorities discussed the UK application at their meetings on 11 July and 25 September 2013.
The Commission service responsible for biocidal products indicated at the Competent Authorities meeting on 25 September 2013 that it will propose that the Commission grants an essential use derogation for the UK for copper in product types 2 and 5 for the purposes of legionella control as soon as its internal procedures allow. The draft decision is available online. This website will be updated to accurately reflect any further developments.
Until formal publication of the decision, HSE�s primary concern remains to control the risk of exposure to Legionella. Whilst the formal decision is awaited, HSE and LA inspectors will continue to take a sensible and proportionate approach to enforcement if they come across these systems. Any enforcement activity will focus on the failure to control the risk of exposure to legionella bacteria and the likelihood of legionnaire�s disease developing in a given situation, rather than on the means of control.

What if I continue to use my system after February 1 2013?
The primary concern of HSE and Local Authorities is that legionella control is not compromised. HSE and LAs will take a sensible and proportionate approach if they come across these systems. The focus of any enforcement activity will be on the failure to control the risk of exposure to legionella bacteria and the likelihood of legionnaire�s disease developing in a given situation, rather than on the means of control. - the fact that the UK has submitted an essential use derogation application to the EU Commission and that a draft derogation has now been proposed
- the necessary continued use of the system for the control of legionella in this interim period

Can I view the �essential use� derogation application and comment on it?

What does an �essential use� derogation mean for me and my system?
A favourable decision by the EC for the essential use derogation application is favourable would allow the continued use of elemental copper as long as industry provides the data required under the Directive by a specified deadline. Until a formal decision is published, the primary concern of HSE and LAs is that legionella control is not compromised. A sensible and proportionate approach to enforcement will be taken if HSE and LA inspectors come across any of these systems after 1 February 2013. My system only adds silver ions to the water. Does this affect me?
No. The decision taken at EU level under the biocides directive applies to the use of elemental copper to produce copper ions that are added to your water for legionella control.
Will HSE and LAs be making specific enforcement visits in relation to these systems?
No. Any action in relation to these systems will only be in relation to visits for other primary purposes.
